1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Attendee”, “you”, “your”) and Tech Industry Night (“Organiser”, “we”, “us”, “our”, “host”) governing your purchase of tickets to, and attendance at, the Tech Industry Night event (“Event”), whether in person or via online access.
By purchasing a ticket, registering for, or attending the Event, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not purchase a ticket or attend the event.
These terms are governed by and construed in accordance with the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.
2. Definitions
In these terms, unless the context otherwise requires:
- “Event” means the Tech Industry Night event, including all in-person activities, presentations, networking sessions, and any online livestream or recorded content made available to ticket holders.
- “In-Person Ticket” means a ticket granting admission to the physical Event venue on the date of the event.
- “Online Ticket” means a ticket granting access to the livestream and/or recorded footage of the Event via Humanitix and Zoom.
- “Recorded Content” means any video, audio, or multimedia recordings of the Event made available to Online Ticket holders.
- “Venue” means Gardens Theatre & P Block at QUT Gardens Point Campus, or such other location as notified by the Organiser.
- “Humanitix” means Humanitix Pty Ltd, the third-party ticketing platform through which Event tickets are sold.
3. Ticket Purchase and registration
3.1. Ticket Types
The Event offers the following ticket types:
- In-Person Ticket: Grants admission to the phusical Event at the Venue, as well as access to any Recorded Content (subject to availability and these Terms).
- Online Ticket: Grants access to the Event livestream and Recorded Content only (subject to availability and these Terms).
- Industry Ticket: Grants admission to the physical Event at the Venue, as well as access to any Recorded Content (subject to availability and these Terms). Additionally, may be asked to interact with other Event attendees.
3.2. Purchase Process
All ticket purchases are processed through the Humanitix platform. By purchasing a ticket, you also agree to Humanitix’s terms of service and privacy policy. The Organiser is not responsible for any technical issues, errors, or disputes arising from the Humanitix platform.
3.3. Ticket Conditions
Each ticket is subject to the following conditions:
- Tickets are non-transferable unless the Organiser provides prior written consent.
- Tickets must not be resold, offered for resale, or used for any commercial purpose (including competitions, promotions, or trade) without the Organiser’s prior written consent.
- Any ticket obtained in breach of these Terms may be cancelled without refund.
- The Organiser reserves the right to impose a limit on the number of tickets that may be purchased per person or per transaction.
- You must provide accurate, complete, and current information when registering. Providing false or misleading information is grounds for cancellation of your ticket without refund.
3.4. Pricing
All ticket prices are displayed in Australian Dollars (AUD) and may be inclusive of GST (where applicable). The Organiser reserves the right to change ticket pricing at any time, but changes will not affect tickets already purchased.
4. Right to Refuse Entry and Deny Service
4.1. Organiser’s Absolute Discretion
The Organiser reserves the right, in its sole and absolute discretion, to refuse entry to, remove from, or deny service at the Event to any ticket holder, regardless of whether a valid ticket has been purchased.
Without limiting the generality of the foregoing, the Organiser may refuse entry to, or remove from, the Event any person who:
- Engages in conduct that is, in the Organiser’s reasonable opinion, disruptive offensive, threatening, abusive, discriminatory, harassing, or otherwise inappropriate.
- Is intoxicated or under the influence of drugs or alcohol to a degree that, in the Organiser’s opinion, poses a risk to themselves or others, or is likely to cause disruption.
- Fails to comply with any reasonable direction given by the Organiser, Event staff, security personnel, or Venue management.
- Breaches any provision of these Terms Engages in any conduct that the Organiser reasonably considers to be a risk to the health, safety, or welfare of any person at the Event.
- Has obtained their ticket through fraud, misrepresentation, or in breach of these Terms.
- Fails to produce valid identification or ticket confirmation when requested.
- Brings prohibited items into the Venue (see section 6.4.).
- Engages in unauthorised recording, streaming, or broadcasting of Event content.
- Disruptive or annoying behaviour when interacting with Event attendees or Industry Stalls.
4.2. No Obligation to Provide Reasons
The Organiser is not obliged to provide reasons for refusing entry or removing an Attendee from the Event, though it will endeavour to act reasonably and in good faith.
4.3. Refund on Refusal
Where the Organiser refuses entry to, or removes an Attendee from, the Event:
- For cause: If the refusal or removal is due to the Attendee’s breach of these Terms or misconduct, no refund will be provided.
- Without cause: If the Organiser refuses entry or removes an Attendee for reasons not attributable to the Attendee’s breach or misconduct, the Organiser will offer a full refund of the ticket purchase price.
4.4 Revocation of Online Access
The Organiser reserves the right to revoke or suspend an Online Ticket holder’s access to the livestream or Recorded Content at any time if the Attendee breaches these Terms, including by engaging in unauthorised redistribution, recording, or sharing of Event content.
4.5. Anti-Discrimination
Nothing in this section authorises the Organiser to refuse entry or deny service on the basis of a protected attribute under the Anti-Discrimination Act 1991 (Qld) or any other applicable anti-discrimination legislation, including race, sex, age, disability, religious belief, gender identity, or sexuality.
5. Refunds, Cancellations, and Changes
5.1. Attendee-Initiated Cancellations
Refund requests initiated by Attendees are subject to the following:
- Requests made more than 14 days before the Event: Full refund.
- Requests made made less than 14 days before the Event: No refund, unless required by law.
Note: Review whether your refund policy complies with the Australian Consumer Law (ACL) requirements, particularly the consumer guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth).
5.2. Organiser-Initiated Cancellation or Postponement
The Organiser reserves the right to cancel, postpone, or reschedule the Event at any time. If the Event is cancelled by the Organiser:
- In-Person and Online Ticket holders will be entitled to a full refund of the ticket purchase price.
- The Organiser will use reasonable efforts to provide notice of cancellation as soon as practicable.
- Refunds will be processed via the original payment method through Humanitix.
5.3. Changes to Event
The Organiser reserves the right to make changes to the Event program, schedule, speakers, venue, or format without notice. Such changes do not entitle Attendees to a refund unless the change is so fundamental as to render the Event materially different from what was advertised.
5.4. Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
6. Event Conduct and Attendee Obligations
6.1. Code of Conduct
All Attendees are expected to conduct themselves in a professional, respectful, and lawful manner at all times during the Event. Without limitation, Attendees must:
- Treat all other attendees, speakers, sponsors, organisers, staff, and venue personnel with courtesy and respect.
- Refrain from engaging in any form of harassment, discrimination, bullying, or intimidation.
- Comply with all reasonable directions of Event staff, Event volunteers, security personnel, and Venue management.
- Comply with all applicable laws and regulations.
- Comply with a business casual dress code (including the wearing of shoes).
6.2. Compliance with Venue Rules
Attendees must comply with all rules, policies, and directions of the Venue, including those relating to health and safety, emergency procedures, and capacity limits.
6.3. Health and Safety
Attendees must:
- Comply with any health and safety requirements communicated by the Organiser before or during the Event, including any COVID-19 or communicable disease protocols in effect at the time of the Event.
- Not attend the Event if they are experiencing symptoms of a communicable disease and the Organiser has communicated that affected persons should not attend.
- Report any safety concerns, incidents, or hazards to Event staff immediately.
6.4. Prohibited Items and Activities
The following items and activities are prohibited at the Event:
- Weapons or anything that could reasonably be used as a weapon.
- Illegal substances.
- Professional recording or broadcasting equipment (unless authorised in writing by the Organiser).
- Distribution of unauthorised promotional materials.
- Alcohol.
7. Intellectual Property and Recordings
7.1. Event Content Ownership
All intellectual property rights in Event content, including presentations, materials, branding, and any Recorded Content, are owned by the Organiser or its licensors, unless otherwise stated. Attendees do not acquire any intellectual property rights by attending the Event or purchasing a ticket.
7.2. Attendee Recording Restrictions
Attendees must not, without the Organiser’s prior written consent:
- Record, photograph, livestream, or broadcast any part of the Event (other than incidental personal photographs for non-commercial use).
- Reproduce, distribute, or make available any Event content or materials.
- Use any Event content or materials for commercial purposes.
7.3. Filming and Photography by the Organiser
The Event will be filmed and photographed by or on behalf of the Organiser. By attending the Event in person, you acknowledge and agree that:
- You may appear in photographs, video recordings, or audio recordings taken at the Event.
- The Organiser and its Industry Partners may use such recordings for promotional, educational, marketing, archival, and commercial purposes, across any medium (including social media, websites, print, and broadcast), in perpetuity, without further notice, consent, or compensation to you.
- You waive any right to inspect or approve the finished photographs, video, or audio recordings, or any use thereof.
If you do not wish to appear in Event recordings, you must notify the Organiser in writing prior to the Event or notify an Event staff member upon arrival. The Organiser will make reasonable efforts to accommodate such requests but cannot guarantee that you will not appear incidentally in wide-angle, crowd, or background shots.
7.4. Recorded Content Online Access
Online Ticket holders and In-Person Ticket holders (where applicable) are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Recorded Content for personal, non-commercial use only. Access to Recorded Content will be available for a period of one (1) year from the date of the Event*, after which the Recorded Content may be removed or made unavailable without further notice.
Attendees must not:
- Download, copy, reproduce, or redistribute the Recorded Content (in whole or in part)
- Share login credentials or access links with any third party
- Screen-record, capture, or otherwise duplicate the Recorded Content
- Use the Recorded Content for any commercial purpose
Breach of this section may result in immediate revocation of access without refund.
*This date is subject to change based on the Organiser’s compliance with third party handlers.
8. Limitation of Liability
8.1. Exclusion of Liability
To the maximum extent permitted by law, the Organiser excludes all liability for any loss, damage, injury, cost, or expense (whether direct, indirect, consequential, or incidental) suffered or incurred by an Attendee arising out of or in connection with:
- Attendance at, or participation in, the Event (whether in person or online)
- Any act or omission of any third party, including other attendees, speakers, sponsors, venue operators, or service providers
- Cancellation, postponement, or changes to the Event
- Loss, theft, or damage to personal property at the Venue
- Technical issues, interruptions, or failures affecting the livestream or Recorded Content
- Any reliance on information, advice, or opinions expressed at the Event
8.2. Cap on Liability
Where the Organiser’s liability cannot be excluded by law, the Organiser’s total aggregate liability to an Attendee for all claims arising out of or in connection with the Event is limited to the amount of the ticket purchase price paid by that Attendee.
8.3. Consumer Guarantee Preservation
Nothing in these Terms purports to exclude, restrict, or modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation (including the Australian Consumer Law) which cannot lawfully be excluded or limited. If such legislation applies, to the extent to which the Organiser is entitled to do so, the Organiser limits its liability to, at the Organiser’s option: providing the services again, or payment of the cost of having the services supplied again.
9. Assumption of Risk
Attendance at the Event is voluntary. By attending the Event in person, you acknowledge and accept that:
- There are inherent risks associated with attending a public event, including (without limitation) the risk of personal injury, illness, property damage, and exposure to communicable diseases
- You attend the Event at your own risk and assume all risks associated with your attendance
- The Organiser has not made any representations or warranties regarding the safety of the Event beyond its obligations at law
10. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold harmless the Organiser, its officers, employees, contractors, agents, and Industry Partners from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with:
- Your breach of these Terms
- Your negligent or unlawful acts or omissions at the Event
- Any claim by a third party arising from your conduct at the Event
11. Privacy
Your personal information is collected, used, and disclosed in accordance with our Privacy Policy, which is available at https://techindustrynight.com/privacy-policy/ and forms part of these Terms. By agreeing to these Terms, you confirm that you have read and understood the Privacy Policy.
12. Frustration of Contract
The Organiser will not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond the Organiser’s reasonable control, including (without limitation) natural disasters, pandemics, epidemics, government restrictions, acts of terrorism, industrial action, power outages, internet or telecommunications failures, or acts of God (“Force Majeure Event”).
In the event of a Force Majeure Event, the Organiser will use reasonable efforts to notify affected Attendees as soon as practicable and will endeavour to reschedule the Event or offer alternative arrangements. If the Event cannot be rescheduled, Attendees will be entitled to a refund in accordance with section 5.2.
13. Third-Party Services and Links
The Event may involve services, platforms, or websites operated by third parties (including Humanitix, venue operators, and streaming platforms). The Organiser is not responsible for the content, availability, privacy practices, or terms of service of any third-party service. Your use of third-party services is at your own risk and subject to those third parties’ respective terms and conditions.
14. General Provisions
14.1. Entire agreement
These Terms, together with the Privacy Policy and any specific conditions communicated at the time of ticket purchase, constitute the entire agreement between you and the Organiser in relation to the Event and supersede all prior agreements, understandings, or representations.
14.2. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be severed to the extent of the invalidity, illegality, or unenforceability, and the remaining provisions will continue in full force and effect.
14.3. Waiver
A failure or delay by the Organiser in exercising any right under these Terms does not constitute a waiver of that right. A waiver by the Organiser of any breach of these Terms does not constitute a waiver of any subsequent breach.
14.4. Assignment
The Organiser may assign or transfer its rights and obligations under these Terms to a third party without your consent. You may not assign or transfer your rights under these Terms without the Organiser’s prior written consent.
14.5. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals therefrom.
14.6. Ammendments
The Organiser reserves the right to amend these Terms at any time. Any material amendments will be communicated to Attendees via website notification and/or update. Continued use of your ticket or attendance at the Event following notification of amendments constitutes acceptance of the amended Terms.
